3rd Circuit Rejects Employer’s Challenge Of Regional Director’s Authority
(May 12, 2016, 10:16 AM EDT) -- PHILADELPHIA — A Third Circuit U.S. Court of Appeals panel on April 21 affirmed a trial court’s ruling rejecting claims by an employer that a National Labor Relations Board regional director who facilitated a contested union election lacked the authority to do so because he was appointed at a time when the NLRB lacked a quorum (Advanced Disposal Services East, Inc. v. National Labor Relations Board, Nos. 15-2229 and 15-2321, 3rd Cir.; 2016 U.S. App. LEXIS 7211).
