Justice: Conflicting Reports Raise Fact Issue As To Causation In Superstorm Sandy Suit

(May 11, 2016, 12:10 PM EDT) -- NEW YORK — A New York justice on April 25 found that conflicting expert affidavits and reports raise material issues of fact regarding whether wind alone or waves and storm surge caused the insureds’ Superstorm Sandy damage that cannot be resolved on summary judgment motions (Jared Della Valle, et al. v. New York Property Insurance Underwriting Association, No. 651798/13, N.Y. Sup., New York Co.; 2016 N.Y. Misc. LEXIS 1547).
