Idaho Supreme Court Denies Borrower’s Counterclaims In Suit Over Deed Of Trust

(May 9, 2016, 9:21 AM EDT) -- BOISE, Idaho — The Idaho Supreme Court on April 26 upheld judgment for the lender in a dispute over a mistakenly released deed of trust that secured a residential mortgage, finding that the reconveyance was properly rescinded and that there was no “sinister scheme” behind it all, as alleged by the borrower (Countrywide Home Loans, Inc. v. Ralph E. Sheets Jr., et al. v. Bank of America, N.A., et al., No. 42063, Idaho Sup.; 2016 Ida. LEXIS 114).
