Judge: Future ACA Benefits Can’t Be Used To Offset Tort Award Against Government

Mealey's (May 4, 2016, 1:48 PM EDT) -- SEATTLE — The United States may not introduce evidence of future Patient Protection and Affordable Care Act (ACA) benefits in an effort to offset any tort award arising from neurological injuries a soldier’s child suffered at birth, a federal judge in Washington held May 2 (Erich Alexander, Johnette Alexander and E.A., a minor child v. United States of America, No. 14-1774, W.D. Wash.; 2016 U.S. Dist. LEXIS 58272).
