Judge Partly Allows Bad Faith Counterclaim To Proceed In Product Liability Dispute
(May 4, 2016, 10:52 AM EDT) -- CINCINNATI — An Ohio federal judge on April 26 granted in part and denied in part an insurer’s motion to dismiss an insured’s bad faith counterclaim in a coverage dispute arising from an underlying products liability claim brought against the insured by a Texas refinery (Valley Forge Insurance Co. v. Fisher Klosterman Inc., No. 14-792, S.D. Ohio; 2016 U.S. Dist. LEXIS 55485).
