Oregon Urges 9th Circuit To Reverse Immunity Ruling In ACA Exchange Spat

(May 2, 2016, 12:56 PM EDT) -- PORTLAND, Ore. — Agreements establishing jurisdiction did not waive 11th Amendment immunity from a Patient Protection and Affordable Care Act (ACA) suit involving the creation of the state’s exchange, Oregon tells the Ninth Circuit U.S. Court of Appeals in an April 28 brief (Oracle America Inc. v. The Oregon Health Insurance Exchange Corp., dba Cover Oregon, et al., Nos. 15-35950, 15-35975, 9th Cir.).
