Benicar MDL Judge Rejects Daiichi’s ‘Woodshedding’ Motion For Physician Contacts

Mealey's (April 28, 2016, 1:30 PM EDT) -- CAMDEN, N.J. — Noting that defense “woodshedding” motions “appear to be de rigueur in multidistrict litigation,” a New Jersey federal magistrate judge in the Benicar MDL on April 6 denied a motion to limit plaintiffs’ ex parte communications with treating physicians and imposed conditions on defense attempts to recruit expert witnesses from the ranks of treating physicians (In Re: Benicar [Olmesartan] Products Liability Litigation, MDL Docket No. 2606, No. 15-2606, D. N.J.; 2016 U.S. Dist. LEXIS 47067).
