5th Circuit: Gym Members’ Contract Class Suit Fails; They Got What They Paid For
(April 26, 2016, 7:09 PM EDT) -- NEW ORLEANS — Gym members suing over alleged contract errors suffered no injury in fact because they received the membership for which they paid, a Fifth Circuit U.S. Court of Appeals panel ruled April 13, upholding the trial court’s dismissal of the class complaint (Russell Wendt, et al. v. 24 Hour Fitness USA, Incorporated, No. 15-10309, 5th Cir.; 2016 U.S. App. LEXIS 6698).
