Judge: Third-Party Claim In Fracking Case Fails; Common- Law Indemnity Not Proper

(April 26, 2016, 2:34 PM EDT) -- PITTSBURGH — A federal judge in Pennsylvania on April 12 ruled that a company’s third-party complaint for common-law indemnity in a hydraulic fracturing lawsuit failed because the facts of the case as pleaded do not support recovery under that claim. Moreover, the judge said, common-law indemnity and contribution claims must be grounded in tortious conduct rather than in a contract action (EQT Production Company v. Terra Services LLC v. Trumbull Corporation and Environmental Construction Inc., No. 14-01053, W.D. Pa.).
