Insurer: Pennsylvania Federal Judge Erred In Finding Exclusion Does Not Apply

(April 26, 2016, 12:22 PM EDT) -- PHILADELPHIA — Because a Pennsylvania federal judge erred in finding that an asbestos exclusion is ambiguous and does not bar coverage for underlying asbestos-related claims filed against the insured, a judgment in favor of the insured should be reversed, an insurer argues in an April 21 reply brief filed in the Third Circuit U.S. Court of Appeals (General Refractories Company v. First State Insurance Co., et al., No. 15-3409, 3rd Cir.).
