3rd Circuit Holds Federal Aviation Act Does Not Preempt Design Defect Claims
Mealey's (April 26, 2016, 11:50 AM EDT) -- PHILADELPHIA — A Third Circuit U.S. Court of Appeals panel on April 19 ruled that a district court erred by granting summary judgment on a woman’s design defect claims in a wrongful death suit against an airplane engine manufacturer, saying that the Federal Aviation Act of 1994 does not preempt all aircraft design and manufacturing claims (Jill Sikkelee v. Precision Airmotive Corporation, et al, No. 14-4193, 3rd Cir.; 2016 U.S. App. LEXIS 7015).
