Trademark Owners Argue To 7th Circuit: Dastar Does Not Bar Infringement Claims

(April 15, 2016, 10:36 AM EDT) -- CHICAGO — The U.S. Supreme Court’s ruling in Dastar Corp. v. Twentieth Century Fox Film Corp. (539 U.S. 23, 28 [2003]) does not bar trademark infringement claims, trademark owners argue in a Dec. 8 brief to the Seventh Circuit U.S. Court of Appeals, asking the court to reverse the dismissal of their case (Phoenix Entertainment Partners, LLC and Slep-Tone Entertainment Corp. v. Dannette Rumsey and Basket Case Pub, Inc., No. 15-2844, 7th Cir.).
