SEC Argues That Review Of SEC Enforcement Action Proceeding Is Not Necessary

(April 15, 2016, 10:18 AM EDT) -- WASHINGTON, D.C. — The U.S. Supreme Court should not grant review of a Securities and Exchange Commission administrative law judge’s (ALJ) ruling holding a securities broker liable for violations of federal securities laws because the broker failed to bring his claim that ALJs are inferior officers under the appointments clause of the U.S. Constitution, the SEC argues in an April 1 opposition brief (Gordon B. Pierce v. Securities and Exchange Commission, No. 15-907, U.S. Sup.; 2016 U.S. S. Ct. Briefs LEXIS 1528).
