Delaware Federal Judge Consolidates Patent Disputes Over Proposed Generic Drugs
(April 14, 2016, 12:02 PM EDT) -- WILMINGTON, Del. — Opposition by Alembic Pharmaceuticals Inc. to a motion to consolidate two separate patent infringement lawsuits was unsuccessful April 12, when a Delaware federal judge instead found that “the questions of law” presented in the cases “fully overlap” (Bayer Pharma AG, et al. v. Alembic Pharmaceuticals Inc., No. 15-832; Bayer Pharma AG, et al. v. Macleods Pharmaceuticals Ltd., et al., No. 15-464, D. Del.; 2016 U.S. Dist. LEXIS 48811).
