Del. Supreme Court Overturns Dismissal Of Warranty Claims Against Finish Maker
(April 12, 2016, 1:10 PM EDT) -- WILMINGTON, Del. — A panel of the Delaware Supreme Court on April 11 overturned a superior court judge’s ruling finding that a property owner’s breach of warranty claims against the manufacturer of a finishing product that was applied to a building were untimely, holding that the warranty issued by the manufacturer was based on future performance (LTL Acres L.P. v. Butler Manufacturing Company, et al., No. 468, 2015, Del. Sup.; 2016 Del. LEXIS 233).
