Claimant Was No Longer Covered Person Under Policy, 9th Circuit Panel Affirms

(April 12, 2016, 9:35 AM EDT) -- SAN FRANCISCO — Because a disability claimant was no longer an employee of the disability plan’s sponsor when she filed a claim for disability benefits, she could not be considered a participant in the plan at issue, the Ninth Circuit U.S. Court of Appeals affirmed April 5 (Isalinda Perez-Jones v. Liberty Life Assurance Company of Boston, et al., No. 14-55455, 9th Cir.; 2016 U.S. App. LEXIS 6233).
