Evidence Of Exposure To Original Asbestos Insulation Lacking, 9th Circuit Says
(April 8, 2016, 8:40 PM EDT) -- LOS ANGELES — A ship is not a product under maritime strict products liability law, and plaintiffs lack sufficient evidence of asbestos exposure from originally installed insulation to proceed on negligence claims, a Ninth Circuit U.S. Court of Appeals panel held March 31 (Carol McIndoe, et al. v. Huntington Ingalls Inc., et al., Nos. 13-56762, 13-56764, 9th Cir.; 2016 U.S. App. LEXIS 5893).
