Arbitrary And Capricious Standard Of Review Applies, Kentucky Federal Judge Says
(April 8, 2016, 9:59 AM EDT) -- LEXINGTON, Ky. — A Kentucky federal judge on March 31 determined that an arbitrary and capricious standard of review should be applied in a disability benefits suit because the insurer demonstrated that it was granted discretionary authority under the plan at issue (Susan Card, a/k/a Karen Card v. Principal Life Insurance Co., No. 15-139, E.D. Ky.; 2016 U.S. Dist. LEXIS 43019).
