5th Circuit Affirms Dismissal Of Yogurt Store Franchisees’ Contract Breach, Fraud Claims

(April 7, 2016, 12:29 PM EDT) -- NEW ORLEANS — A Fifth Circuit U.S. Court of Appeals panel on April 6 affirmed a lower court’s grant of partial summary judgment to yogurt store franchisor Yumilicious Franchise L.L.C. and affirmed the dismissal of breach of contract and fraud claims of franchisees who opened two yogurt stores in South Carolina that they were forced out of business due to contract breaches committed by Yumilicious (Yumilicious Franchise, L.L.C. v. Matthew Barrie, et al., No. 15-10508, 5th Cir.; 2016 U.S. App. LEXIS 6310).
