Cherokee Casino Says Worker’s Tardy Fee Payment Bars Arbitration

(April 7, 2016, 11:12 AM EDT) -- TAHLEQUAH, Okla. — The Cherokee Supreme Court should reverse a tribal court’s finding that the late payment of a $100 filing fee for an arbitration request in a workers’ compensation dispute “substantially complied” with the Cherokee Nation Workers’ Compensation Act (CNWCA) because tribal law clearly states that the fee has to be filed on time, a Cherokee casino company and its insurer argue in their March 18 appeal brief (Carey Baker v. Cherokee Nation Entertainment, et al., No. SC-16-01, Cherokee Nation Sup.).
