Insurer Did Not Waive Plan’s Limitations Period, 9th Circuit Panel Affirms

Mealey's (April 7, 2016, 10:08 AM EDT) -- SAN FRANCISCO — A disability insurer did not waive a plan’s contractual limitations provision because the limitations period had already expired when the claimant filed a claim for benefits, the Ninth Circuit U.S. Court of Appeals said March 23 (Vandana Upadhyay v. Aetna Life Insurance Co., et al., No. 14-15420, 9th Cir.; 2016 U.S. App. LEXIS 5418).
