10th Circuit Overturns $22.5M Punitive Award In Carbon Monoxide Poisoning Suit

Mealey's (April 6, 2016, 2:16 PM EDT) -- DENVER— A 10th Circuit U.S. Court of Appeals panel on April 1 overturned a $22.5 million punitive damages award against a company that was in charge of the daily maintenance of an apartment complex where a resident was exposed to and injured by carbon monoxide, saying the amount of the award was excessive and unconstitutional (Amber Nicole Lompe v. Sunridge Partners LLC, et al. No. 14-8082, 10th Cir.; 2016 U.S. App. LEXIS 6053).
