9th Circuit Partially Reinstates Worker’s Claims In Accrued Service Suit
(April 6, 2016, 1:18 PM EDT) -- SAN FRANCISCO — A former on-and-off Lockheed Martin Corp. worker may partially proceed with his breach of fiduciary duty claim based on his allegation that the company promised that it would allow him to continue to accrue credited service after his second rehire, the Ninth Circuit U.S. Court of Appeals ruled March 29 (Charles Guenther v. Lockheed Martin Corporation, et al., No. 14-15193, 9th Cir.; 2016 U.S. App. LEXIS 5783).
