California Judge: No Defense Owed For Suits Alleging Prescription Drug Abuse Scheme
(April 6, 2016, 10:23 AM EDT) -- SANTA ANA, Calif. — A California judge on March 17 found that insurers have no duty to defend a pharmaceutical company insured against underlying allegations that it knowingly and willfully participated in a systematic process of misleading doctors and patients as to opioids' effectiveness and addictiveness (Travelers Property Casualty Company of America, et al. v. Actavis PLC, et al., No. 2014-00746842, Calif. Super., Orange Co.).
