4th Circuit: Mortgagee’s Default Notice Properly Included Future Installment

(April 5, 2016, 9:36 PM EDT) -- RICHMOND, Va. — A mortgagee did not breach its contract with delinquent borrowers when it included a future installment in its amount necessary to cure as that payment would be due during the 30-day notice, the Fourth Circuit U.S. Court of Appeals ruled March 23, upholding a trial court’s ruling (Balwinder Singh Whala, et al. v. PNC Bank, National Association, No. 15-1091, 4th Cir.; 2016 U.S. App. LEXIS 5242).
