Drug Rep Who Won Free-Speech Case Loses Suit Alleging Malicious Prosecution

(April 5, 2016, 7:38 AM EDT) -- NEW YORK — Former drug sales representative Alfred Caronia’s countersuit alleging malicious prosecution for being charged with off-label promotion of a drug was properly dismissed by a trial court, a panel of the Second Circuit U.S. Court of Appeals ruled March 17 (Alfred Caronia, et al. v. Orphan Medical, Inc., et al., No. 15-2838, 2nd Cir.; 2016 U.S. App. LEXIS 4849).
