7th Circuit Upholds Partial Verdict Against Business In Faxed Ad Suit

(March 31, 2016, 7:29 AM EDT) -- CHICAGO — An Illinois federal magistrate judge did not err when she granted summary judgment to a portion of a class, of which the lead plaintiff was not part, in a suit accusing a small business of violating the Telephone Consumer Protection Act (TCPA) by sending unsolicited faxed advertisements, the Seventh Circuit U.S. Court of Appeals ruled March 21 (Bridgeview Health Care Center, Ltd., et al. v. Jerry Clark, d/b/a Affordable Digital Hearing, Nos. 14-3728 and 15-1793, 7th Cir.; 2016 U.S. App. LEXIS 5082).
