Kansas Federal Judge Refuses To Toss 2 Plaintiffs’ Breach Of Fiduciary Duty Claims

(March 30, 2016, 2:30 PM EDT) -- KANSAS CITY, Kan. — A Kansas federal judge on March 15 denied a summary judgment motion seeking to toss breach of fiduciary duty claims brought by two of 17 named retirees who filed a class suit alleging that their medical and life insurance benefits were improperly altered or eliminated in violation of the Employee Retirement Income Security Act (William Douglas Fulghum, et al. v. Embarq Corporation, et al., No. 07-2602, D. Kan.; 2016 U.S. Dist. LEXIS 33568).
