High Court Will Not Consider ERISA Preemption Ruling

Mealey's (March 28, 2016, 12:02 PM EDT) -- WASHINGTON, D.C. — The U.S. Supreme Court on March 28 declined to consider a Ninth Circuit U.S. Court of Appeals’ ruling affirming a district court’s dismissal of breach of contract claims after determining that the claims are preempted under the Employee Retirement Income Security Act (Oregon Teamster Employers Trust v. Hillsboro Garbage Disposal Inc., et al., No. 15-929, U.S. Sup.).
