Judge: State Agency Has Primary Jurisdiction Over Perchlorate Cleanup

Mealey's (March 28, 2016, 11:00 AM EDT) -- OKLAHOMA CITY — A federal judge in Oklahoma on March 25 awarded summary judgment to Halliburton Energy Services Inc. (HESI) on a couple’s claim for injunctive relief that would require the company to remediate perchlorate from groundwater that allegedly seeped onto their property, ruling that the Oklahoma Department of Environmental Quality (ODEQ) has primary jurisdiction over remediation (Stephen G. Jones, et al. v. Halliburton Energy Services Inc., No. 11-cv-1322-M, W.D. Okla.; 2016 U.S. Dist. LEXIS 39263).
