Fracking Company’s Objection To Fines For Tainted Water Fails, Judge Rules

Mealey's (June 18, 2015, 9:54 AM EDT) -- HARRISBURG, Pa. — A Pennsylvania judge on Feb. 20 dismissed a lawsuit in which a hydraulic fracturing company objected to penalties assessed against it for contaminating groundwater, ruling that the company’s allegation of harm against it was “merely speculative” and the state’s environmental hearing board has the right to impose those penalties (EQT Production Company v. Department of Environmental Protection of the Commonwealth of Pennsylvania, No. 485 MD 2014, Pa. Cmwlth.).
