Judge: No Coverage For ‘Off Premises Power Outage’ In Superstorm Sandy Dispute

(March 25, 2016, 12:05 PM EDT) -- NEW YORK — A New York justice on March 9 held that a restaurant owner insured’s claim for spoiled food and business income loss was caused by an "off premises power outage" that is not a covered cause of loss under its commercial general liability insurance policy, granting the insurer’s motion for summary judgment in a Superstorm Sandy breach of contract lawsuit (CAC 3 LLC d/b/a Yushi-Maiden Lane v. Tower National Ins. Co., Index No. 650459/2014, N.Y. Sup., New York Co.).
