Colorado Supreme Court: County Failed To Prove Historical Water Use
(March 23, 2016, 2:53 PM EDT) -- DENVER — The Colorado Supreme Court on March 21 affirmed a state water court’s denial of Boulder County’s water rights change application, agreeing that the county failed to carry its burden of proving historical consumptive use (HCU) of water (County of Boulder v. Boulder & Weld County Ditch Company, et al., No. 14SA348, Colo. Sup.; 2016 Colo. LEXIS 272).
