Riata Heart Device Case Dismissed Without Prejudice On Preemption, Pleading
(March 23, 2016, 2:40 PM EDT) -- TERRE HAUTE, Ind. — A plaintiff who claims to have suffered ongoing injuries from a Riata heart device failed to prove that his claims parallel federal requirements, but he will be allowed to replead his complaint, an Indiana federal judge ruled March 21 (Miles Thompson v. St. Judge Medical, Inc., No. 16-41, S.D. Ind., Terre Haute Div.; 2016 U.S. Dist. LEXIS 35927).
