Claimant Appeals To 6th Circuit To Award Her Underinsured Motorist Benefits

(March 23, 2016, 10:40 AM EDT) -- CINCINNATI — A claimant has asked the Sixth Circuit U.S. Court of Appeals to reverse a lower court’s ruling that refused to award her underinsured motorists benefits for an underlying accident, arguing that the lower court created a fact issue as to what would constitute a “temporary use” of the vehicle that should have precluded summary judgment in favor of the insurer (Pamela Johnson v. The Florists' Mutual Insurance Co., No. 15-6117, 6th Cir.).
