Nevada High Court Finds Error In Barring Testimony On Low-Impact Defense

(March 21, 2016, 1:10 PM EDT) -- LAS VEGAS — A trial judge erred in granting a motion to preclude a plaintiff from presenting a low-impact defense in a personal injury case arising out of an automobile accident, the Nevada Supreme Court ruled March 17, finding that the judge misapplied Hallmark v. Eldridge (124 Nev. 492, 500-02, 189 P.3d 646, 651-53 [2008]) (Jenny Rish v. William Jay Simao and Cheryl Ann Simao, Nos. 58504, 59208 & 59423, Nev. Sup.; 2016 Nev. LEXIS 151).
