5th Circuit Affirms Dismissal Of Unreasonable Collection Suit As Poorly Pleaded
(March 21, 2016, 10:29 AM EDT) -- NEW ORLEANS — A Texas man’s claims over the foreclosure of his property were properly dismissed for failure to state a claim, the Fifth Circuit U.S. Court of Appeals ruled March 3, finding that the plaintiff did not provide facts or legal analysis to establish his claims of unreasonable collection and wrongful acceleration of his loan (Richard H. Alsenz v. Aurora Bank FSB, et al., No. 12-20524, 5th Cir.; 2016 U.S. App. LEXIS 4067).
