5th Circuit: Sierra Club Has Right To Intervene In Reverse FOIA Case

Mealey's (March 18, 2016, 1:10 PM EDT) -- NEW ORLEANS — A Fifth Circuit U.S. Court of Appeals panel ruled March 17 that a federal judge in Louisiana erred when denying Sierra Club’s motion to intervene of right in a reverse Freedom of Information Act (FOIA) suit, holding that the group and the U.S. Environmental Protection Agency have divergent interests in the case (Entergy Gulf States Louisiana LLC, et al. v. U.S. Environmental Protection Agency v. Sierra Club, No. 15-30397, 5th Cir.; 2016 U.S. App. LEXIS 4928).
