Florida Supreme Court Rules Engle Plaintiffs Can Pursue Punitive Damages
(March 18, 2016, 11:07 AM EDT) -- TALLAHASSEE, Fla. — The Florida Supreme Court on March 17 unanimously held that Engle progeny plaintiffs suing tobacco companies under theories of negligence and strict liability are entitled to seek punitive damages, finding that the benefit the progeny plaintiffs receive from res judicata does not preclude them from amending their complaints for the purposes of seeking punitive damages (Lucille Ruth Soffer v. R.J. Reynolds Tobacco Company, No. SC13-139. Fla. Sup.).
