1st Circuit: Court Properly Invoked Res Judicata In Dismissing Direct Action Suit
(March 15, 2016, 4:40 PM EDT) -- BOSTON — The First Circuit U.S. Court of Appeals on March 4 affirmed a lower federal court’s dismissal of an underlying claimant’s second lawsuit brought under Puerto Rico’s direct action statute against insurers, finding that the lower court correctly invoked the doctrine of res judicata (Heriberto Medina-Padilla, et al. v. United States Aviation Underwriters Inc., et al., No. 15-1467, 1st Cir.; 2016 U.S. App. LEXIS 4176).
