Judge Remands ERISA Spat, Warns Against Claiming ACA Grandfathered Status
(March 15, 2016, 2:01 PM EDT) -- CLEVELAND — An insurer waived any entitlement its policy had to grandfathered status under the Patient Protection and Affordable Care Act (ACA) by not properly disclosing contact information, a federal judge in Ohio held March 11 in remanding a coverage dispute (Emil Soehnlen v. Fleet Owners Insurance Fund, No. 15-1181, N.D. Ohio; 2016 U.S. Dist. LEXIS 31687).
