Request For Preemptive Fee Award Denied In Massachusetts Patent Case
Mealey's (March 11, 2016, 3:17 PM EST) -- BOSTON — A motion by a patent infringement defendant for an order that would require a plaintiff to post a $2.25 million bond to preemptively cover the defendant’s attorney fees and costs was denied March 9 by a Massachusetts federal judge (DataTern Inc. v. MicroStrategy Inc., et al., No. 11-11970, -12220, D. Mass.; 2016 U.S. Dist. LEXIS 30128).
