Magistrate In Fracking Case Appoints Mediator In Wake Of Discovery Dispute

Mealey's (June 17, 2015, 4:24 PM EDT) -- FORT WORTH, Texas — A chief magistrate judge in Texas on Jan. 12 issued an order appointing a mediator in the dispute involving a man who sued a hydraulic fracturing company for allegedly causing the wrongful death of his mother. The parties, who have had a conflict related to discovery requests, were unable to agree on a mediator based on allegations that some of the discovery requests at issue were “abusive” (Daniel W. Nicholson v. XTO/Exxon Energy Inc., No. 13-899, N.D. Texas).
