Systems Inc. Asks High Court To Review Design Patent Damages Standard

(March 3, 2016, 3:41 PM EST) -- WASHINGTON, D.C. — In light of Apple, Inc. v. Samsung Electronics Co. (786 F.3d 983 [Fed. Cir. 2015]), a maker of loading dock equipment on Jan. 28 petitioned the U.S. Supreme Court to review an appellate court standard that requires patent infringers to pay design patent holders all profits from the infringing product, not just for the infringing portion of the design (Systems, Inc. v. Nordock, Inc., No. 15-978, U.S. Sup.).
