Indian Homeowner Loses Bid To Have Claims Decided In Federal Court
Mealey's (March 3, 2016, 2:20 PM EST) -- SCRANTON, Pa. — A Pennsylvania federal judge on March 1 dismissed a woman’s claims that she is exempt from paying property taxes on her home because she is an “Indigenous American Indian,” finding that he lacks subject matter jurisdiction because the claims should be pursued in state court under the federal Tax Injunction Act (Tonia Scott v. Cynthia Gehris, et al., No. 16-0340, M.D. Pa.; 2016 U.S. Dist. LEXIS 24927).
