Panel: Man May Claim A Portion Of A Royalty Interest In Fracking Land

(March 2, 2016, 4:16 PM EST) -- HOUSTON — A Texas appeals court on March 1 ruled that three family members are prevented from claiming a royalty interest in property used for hydraulic fracturing based on their conveyance of their interest to a bank; however, the appeals panel said that judicial estoppel did not apply to the case and that one family member is not barred from claiming a one-fourth royalty interest in the land through his father’s estate (Spartan Texas Six Capital Partners Ltd., et al. v.
