7th Circuit Finds Expiration Of Permits To Build Wells Moots Challenge

(March 2, 2016, 11:37 AM EST) -- CHICAGO — A Seventh Circuit U.S. Court of Appeals panel on Feb. 23 denied petitions filed by four landowners challenging the U.S. Environmental Protection Agency’s decision to award permits to FutureGen Industrial Alliance to build wells to store carbon dioxide after finding that the expiration of the permits earlier in the month mooted the petitioners’ claims (DJL Farm LLC v. U.S. Environmental Protection Agency, Nos. 15-2245, 15-2246, 15-2247 & 15-2248, 7th Cir.; 2016 U.S. Dist. LEXIS 3128).
