8th Circuit Upholds Ruling Finding Road Salt Is Not Hazardous Substance

LOUIS — An Eighth Circuit U.S. Court of Appeals panel on Feb. 22 affirmed a federal judge in Nebraska’s ruling dismissing a man’s lawsuit accusing the City of Omaha of violating the Resource Conservation and Recovery Act (RCRA) after agreeing with the judge that the plaintiff failed to show that road salt is a hazardous substance under the act (Randall Krause v. City of Omaha, No. 15-2985, 8th Cir.; 2016 U.S. App. LEXIS 3018).
