Federal Appeals Panel Reverses Summary Judgment In Trip And Fall Suit

(February 26, 2016, 10:45 AM EST) -- NEW ORLEANS — The Fifth Circuit U.S. Court of Appeals on Feb. 19 ruled that a lower court erred in granting summary judgement to a clothing store after finding that a jury could conclude that the lower part of a clothing rack that a woman tripped over was not an open and obvious hazard (Virgie Ray v. Stage Stores, Inc., et al., No. 15-30787, 5th Cir.; 2016 U.S. App. LEXIS 2895).
