2nd Circuit: Investor Opted Out Of Settlement Class, Cannot Appeal

(February 26, 2016, 7:39 AM EST) -- NEW YORK — Ruling that an investor cannot appeal the terms of a settlement agreement in a shareholder derivative lawsuit because he opted out of the settlement class and is not a party to the settlement, the Second Circuit U.S. Court of Appeals on Feb. 19 granted a motion to dismiss the appeal, which was filed by the lead plaintiffs in the action (In re DHB Industries Inc. Class Action Litigation, No. 15-2932, 2nd Cir.).
